Preamble
The www.aroma-zone.com website (the "Site") is an information and e-commerce site accessible via the Internet and open to all users of this network. It is published by Hyteck Aroma-Zone ("Aroma-Zone"), a public limited company with capital of 68.604.61 Euros, whose registered office is located at 25 rue de l'Ecole de Médecine, registered with the Paris Trade and Companies Register under number 334 806 502, whose intra-community VAT number is: FR 38 334 806 502 and whose ADEME identifier is: FR005202_01NEEB and REP EEE: FR005202_05J0FN.
Aroma-Zone offers for sale to Internet users browsing the Site (the "User") a certain number of products and in particular essential oils, cosmetic ingredients, cosmetics, empty containers and accessories manufactured by and/or for Aroma-Zone (the "Products"). The User having validated an order will be referred to asthe "Customer".
Any order for a Product offered on the Site implies prior consultation and express acceptance without reservation of the present General Terms of Sale (the "GTS"), manifested by ticking the box "I declare that I have read and accept the Aroma-Zone General Terms of Sale and that I have been informed of my right of withdrawal".
ARTICLE 1 - PURPOSE
The purpose of these General Terms of Sale is to define the terms and conditions of distance selling between Aroma-Zone, on the one hand, and any natural person who is not a merchant and who is of legal age or a minor, with the prior consent of their legal representative only, making a purchase on the Site (hereinafter the "Customer"), on the other hand.
These General Terms of Sale, drawn up in the French language, specify in particular the various stages necessary for the Customer to place an order, the terms of payment and delivery and the monitoring of the Customer's order.
These General Terms of Sale apply to the exclusion of any other document, and in particular any of the Customer's conditions of purchase.
ARTICLE 2. CONDITIONS GOVERNING ACCESS TO AND OPERATION OF THE SITE
2.1 Operation of the Site
Aroma-Zone cannot guarantee constant availability or uninterrupted access to the Site. However, Aroma-Zone endeavours to ensure a high quality user experience when browsing the pages of the Site. Aroma-Zone reserves the right to suspend, without prior notice, access to the Site and its Products, for reasons of maintenance or updating of shared information.
The content, presentation and operation of the Site are subject to modification, deletion or updating at the discretion of Aroma-Zone, at any time and without notice, according to the commercial policy of the group and the operational requirements of the Site, it being understood that such modifications, deletions or updates will not affect orders already placed.
Consequently, the Customer will only be able to order the Products present on the Site on the day of consultation.
2.2 Access to the Site
Orders are placed on the Site, which is accessible via the Internet 24 hours a day, 7 days a week, with the exception of situations of force majeure, events beyond the control of Aroma-Zone, or during maintenance, updates, technical improvements, or modification of content.
ARTICLE 3 - PRODUCTS
3.1 Products
The Products offered for sale by Aroma-Zone are those which appear on the Site, on the day that the User visits the Site and within the limit of available stocks.
The Products are presented by means of an information sheet (photograph, product description, composition and price) created the utmost accuracy and precision in order to provide the most accurate and complete description.
Aroma Zone cannot be held responsible for minor variations from the actual products.
The Customer must refer to the description of each Product in order to see its properties and essential characteristics.
Aroma-Zone cannot be held liable to the Customer or to any third party for the harmful consequences of the removal of a Product from the Site, or for the replacement or modification of any content or information appearing on this Site.
In the event that one of the Products is unavailable, the User or Customer will be informed:
either when browsing the site
or following validation of the order and before delivery, by email.
As payment is debited at the time the Product is ordered, in the event of unavailability after the Order has been placed, Aroma-Zone will reimburse the Customer within fourteen (14) days.
3.2 Use of Products
Certain Products offered for sale by Aroma-Zone may be mixed and altered by the Customer. Given the nature of the Products, it is imperative that the Customer becomes acquainted with the precautions for use and mixing specific to each Product.
Aroma-Zone cannot be held responsible for any failure to observe these precautions.
Aroma-Zone attaches the precautions for use of the Products ordered (in particular essential oils, hygiene and safety conditions for home cosmetics) to each order. The Customer must take note of the precautions for use before using Aroma-Zone Products and respect them when using any Aroma-Zone Product.
If the precautions for use were not included with the shipment of a Product, the Customer must inform Customer Service as soon as possible so that a copy can be sent to them. In any event, the precautions for use can also be downloaded here: "Precautions for the use of essential oils and good manufacturing practice for homemade cosmetics".
The Customer who gives an Aroma-Zone Product as a gift is obliged to give the precautions for use with the Aroma-Zone Product to the recipient of the gift. Aroma-Zone shall not be held responsible for any damage caused by misuse of one of its Products or by failure to comply with the precautions for use and conditions of hygiene and safety when using one of its Products communicated at the time of ordering the product and available at the above-mentioned link.

Essential oils
Essential oils are very powerful concentrates and can be dangerous if not used correctly. It is the Customer's responsibility to take particular care when handling these Products.
Use of essential oils for therapeutic purposes
Essential oils are not harmless products and contain very high percentages of active substances. The information provided on the Site is taken from reference works on aromatherapy. It is provided for information purposes only and in no way constitutes medical information, nor does it incur the liability of Aroma-Zone.
Aroma-Zone does not encourage self-medication. For any use of essential oils for therapeutic or treatment purposes, Aroma-Zone reminds you to first consult a doctor or a qualified pharmacist.
Home-made cosmetics
On its Website, Aroma-Zone offers cosmetic ingredients for home use. Aroma-Zone reminds you that the marketing of cosmetics is subject to strict regulations. Any resale of a Product is therefore governed, in addition to the contractual provisions between the Customer and Aroma-Zone, by the legal and regulatory provisions relating to the marketing of cosmetic products.
Any re-use of Products by the Customer for the purpose of manufacturing and/or marketing and/or commercially exploiting cosmetic products will release Aroma-Zone from all liability.
3.3 Resale of Aroma-Zone products
The resale of Aroma-Zone products is only authorised if it is provided for in a specific written contract signed between the Customer/Reseller and Aroma-Zone. In the absence of such a contract, any resale and/or commercial exploitation of one or more Products, even when incorporated or mixed in a more complex preparation, is strictly forbidden.
Similarly, any repackaging of a Product for resale under another brand name is strictly forbidden, except with the express prior written consent of Aroma-Zone.
ARTICLE 4 - RATINGS AND COMMENTS BY INTERNET USERS
After purchasing a Product, Customers may leave reviews for the product bought. Aroma-Zone does not receive any consideration in exchange for the reviews published by the Customer on the Site. The Customer may also view the reviews and recommendations of other internet users. The opinions and recommendations expressed for each Product are the sole responsibility of the latter. These opinions and recommendations may not under any circumstances constitute a contractual element on the part of Aroma-Zone, nor incur its liability. Aroma-Zone checks reviews and reserves the right to delete any disrespectful, inappropriate or offensive review or comment.
The symbols in the form of stars appearing on the Site next to the Products represent the average ratings, at a given moment, left by the people who have expressed their opinion on our Site about this Product. They may therefore change every day.
The total number of reviews appearing on the Site includes customer reviews from all countries. Any User can view them by changing country via the flag in the site menu.
ARTICLE 5 - PRICES
5.1 Prices
Without prejudice to orders placed by the Customer, Aroma Zone reserves the right to modify its prices at any time. However, it undertakes to apply the prices in force at the time the order is placed, subject to availability on that date.
Prices apply to distance selling.
The prices indicated on the Site are guaranteed on the day of the order within the limits of available stocks, and except in the event of an obvious typographical error or omission.
The prices of the Products are indicated in euros and are valid for the territories of the European Union, excluding DOM and TOM.
They take into account any discounts and the VAT of the European country of destination, applicable on the day of the order.
For orders delivered outside the European Union and to French Overseas Departments and Territories:
Any Order placed on the Site and delivered outside the European Union, to French Overseas Departments and Territories, and to other areas not subject to VAT, will be invoiced without VAT and may be subject to any taxes, customs duties and other related charges that are imposed when the parcel reaches its destination. These additional costs are the sole responsibility of the Customer. It is the Customer's responsibility to check with the local authorities.
The Products marketed by Aroma Zone comply with French regulations. It is therefore the Customer's responsibility to check with the local authorities in their country for any restrictions on the import and use of the Products ordered.
Aroma Zone cannot be held responsible for the purchase of a Product that is considered non-compliant in a given country, even though this Product complies with French regulations.
Delivery charges:
The prices indicated do not include delivery charges, which will be invoiced in addition or offered depending on the amount of the order and the country of delivery, and will be specified to the User when the order is finally confirmed.
These delivery charges do not include customs duties and other additional charges that may be required when entering certain countries; these charges remain the sole responsibility of the Customer.
The Products remain the property of Aroma Zone until delivery to the Customer.
5.2 Commercial offers
Promotional offers are valid for the period indicated, while stocks last. Orders can only be accepted if the prices quoted are in line with those of the current offer.
The User may also have received a commercial offer by email. In this case, they must enter and validate their "advantage code" in the space provided for this purpose on the Order Summary page.
5.3. Gifts
The Customer may offer gifts to friends and family via the Site. The ordering procedure is the same as for personal purchases. The Aroma-Zone Site allows the Customer to send a personalised message to the recipient of the gift. This message will appear on the document accompanying the goods on delivery.
Aroma-Zone guarantees that the price of the item(s) offered will not appear on the document accompanying the goods on delivery.
The recipient of the gift will also benefit from all the guarantees stipulated in article 13 below.
ARTICLE 6 - ACCOUNT CREATION
The creation of a User/Customer account (the "Account") is compulsory in order to place an order.
The User's registration on the Site is validated by Aroma-Zone after verification of the standard form completed by the User. The User receives an email confirming registration.
When creating an Account, the User must ensure that the data provided is accurate and complete. The User must always keep their personal details up to date. In the event of an error in the recipient's details, Aroma-Zone cannot be held responsible for the impossibility of delivering the Products.
Registration on the Site is reserved for individuals of legal age and with full legal capacity to contract.
ARTICLE 7 - ORDER REGISTRATION AND VALIDATION
The User can view the various Products offered for sale by Aroma-Zone on its Site.
The User may browse freely through the various pages of the Site without being bound by any order.
Any order implies acceptance of the prices and description of the Products available for sale.
Aroma-Zone undertakes to honour orders received on the Site only within the limits of available stocks of Products.
Aroma-Zone cannot be held responsible for any typing errors and the consequences thereof.
Aroma-Zone reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or any other legitimate reason within the meaning of article L.121-11 of the French Consumer Code.
Aroma-Zone reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk.
All orders imply unreserved acceptance of these General Terms of Sale.
The placing of an order by the Customer implies full and unreserved acceptance of these General Terms of Sale, to the exclusion of any other General Terms of Sale.
7.1 Placing an order
Validation of the Product Order placed by the Customer on the Site is subject to compliance with the process described below:
To place an Order, the Customer must follow all the instructions given on the Site.
Create their Customer account (hereinafter referred to as the "Account"), or enter their username and password. The Customer undertakes to provide true and sincere information and to inform Aroma-Zone of any changes concerning themselves; The Customer is reminded that their password is personal and confidential. It is also specified that the User is informed and agrees that the use of these two identifiers constitutes proof of their identity and expresses their consent.
Taking note of the essential characteristics of the Product as presented on the Site and selecting the Product;
Add the selected Product(s) to the basket; the basket can be accessed at any time for modification or validation;
Validate the basket after checking its contents;
Access their account in order to confirm and complete the details required for delivery; if the Customer does not already have an account on the Site, create their customer account and fill in the required identity details;
Check the information given in the Order summary, and accept without reservation the Site's current General Terms of Sale;
Confirm the Order;
Enter and validate the online payment details.
The Customer's final acceptance of the Order is evidenced by the validation of their payment, regardless of the payment method chosen from those offered at the time the Order was placed.
Commercial offers/Discounts
To benefit from a commercial offer that has been sent to them, Users must enter and validate their "advantage code" in the field provided on the page displaying their "Basket".
Gift card
To use a gift card, the User must enter and validate their gift voucher code in the field provided on the page displaying their "Basket".
7.2 Order confirmation
Within one hour of placing the order, the Customer will receive a confirmation email which will include:
Confirmation that their order has been registered,
A summary of the items ordered,
The total amount of the order,
The associated delivery costs, where applicable,
The estimated delivery date or delivery time,
The method of payment chosen,
Information about the right of withdrawal,
A summary of their personal details, including the delivery address,
Confirmation that their card will be debited immediately after the order has been placed.
These General Terms of Sale
When the User confirms payment, the order is recorded and the User becomes a Customer.
The sale is not considered final until Aroma-Zone has sent confirmation of acceptance of the order to the Customer by e-mail and Aroma Zone has received payment in full.
The Customer accepts that the order confirmation is considered proof of the contractual relationship between the Parties.
ARTICLE 8 - TERMS OF PAYMENT
The payment options available when placing an order are bank card (Visa, Mastercard, CB and JCB etc.) and PayPal, and appear automatically at the payment stage.
Certain bank cards or specific payment methods may not be accepted depending on the country of invoicing or the issuing bank. These restrictions will be clearly indicated during the order process.
Aroma-Zone reserves the right to remove or add payment methods without prior notice. In addition, payment applications operate according to their own General Conditions of Use.
It is important to note that transactions can only be paid in euros for countries outside the European Union.
Aroma Zone reserves the right to cancel an order for just cause and in particular for an order which, when scored by the fraud module, presents a risk of fraudulent use of a bank card.
8.1 Payment security
By selecting the bank card to make the payment, the Customer is automatically redirected to the electronic payment server of the secure payment platform.
This platform is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data relating to means of payment.
This means that only the payment service provider chosen by Aroma Zone is aware of your bank details. It is neither transmitted nor stored on Aroma Zone's computer systems, nor handled or manipulated by its staff.
ARTICLE 9 - ORDER TRACKING AND CHANGES
On receipt of the order summary, the Customer will have access to "order tracking" by clicking on "my account" and logging in using their e-mail address and password.
It is the Customer's responsibility to check the accuracy of the order and to report any errors immediately.
9.1 Changes
Changes to the composition of an order (products, quantities, etc.), to the contact details associated with it (delivery address, invoicing address, etc.) or to the application of a benefit or discount must be made before the order is paid for. Once payment has been made, the order can no longer be modified, including by Customer Services.
9.2 Suspension of orders
Aroma-Zone reserves the right to suspend the processing of an order and any delivery in the event of refusal to authorise payment by officially accredited organisations or in the event of non-payment.
Aroma-Zone also reserves the right to refuse to make a delivery or to honour an order from a Customer who has not paid in full or with whom a payment dispute is in progress.
9.3. Archiving the order
The Customer's basket is archived and kept for future orders for a period of sixty (60) days, even if the Internet connection is interrupted. However, in order to access the archived basket, the Customer will have to reconnect to the Site using the same computer with the same IP address for connection to the service.
In accordance with article L.213-1 of the French Consumer Code, details of orders for a sum of €120 or more are archived on a secure server for a period of ten (10) years.
ARTICLE 10 - DELIVERY
Delivery is constituted by the transfer to the Customer of physical possession or control of the Product.
10.1 Product delivery costs
For each order, a fixed contribution to delivery costs is requested.
The flat-rate contribution is indexed to the delivery method chosen by the Customer when placing the order and is invoiced per country.
As stated in article 5 of these terms and conditions, delivery costs do not include customs duties and other additional costs that may be required when entering certain countries; these costs remain the sole responsibility of the Customer.
10.2 Delivery times and methods
The estimated delivery date when the order is finalised is given for information purposes only and does not constitute a guaranteed date.
It takes into account the preparation time and delivery time described below:
Preparation time
Aroma-Zone undertakes to do its utmost to process and prepare orders within a maximum of 2 to 3 working days from order confirmation, subject to product availability.
In the event of exceptional circumstances or periods of high activity, this period may be extended. In this case, the Customer will be informed by any appropriate means.
Delivery times
The average delivery time includes the time taken by Aroma-Zone to process orders as well as the transport time taken by the carrier.
Metropolitan France
Orders are dispatched within an average of 48 working hours following receipt of payment for the Order, unless otherwise indicated on the "basket" page. Delivery times must be added to this.
At certain times (particularly during sales operations), the processing time may be longer due to the greater number of orders.
Delivery times:
Standard delivery: within 48 to 72 hours in working days after the carrier has taken charge of the parcel.
Express delivery: within 24 hours (working days) of the carrier picking up the parcel.
Relay point delivery: within 48 to 72 hours in working days after the carrier has taken charge of the parcel.
Click & Collect delivery: within 24 hours in working days after the carrier has taken charge of the parcel.
These times do not include postal delivery problems.
For deliveries outside mainland France, delivery times and shipping methods vary according to the destination country and will be specified when the order is placed and indicated by clicking here.
These times do not include postal delivery problems or cases of force majeure. The Seller cannot be held responsible for delays due to an incorrect or incomplete address provided by the Customer.
Aroma-Zone cannot be held responsible for delays in delivery caused by a case of force majeure (as defined in article 14 below) or by the Customer providing an incorrect or incomplete address.
10.3 Delivery address
The Products ordered will be sent to the address indicated by the Customer during the ordering process. The delivery address can no longer be changed once the order has been validated by the Customer. It is therefore the Customer's responsibility to check all information before confirming payment. The transfer of risks takes place when the Products are delivered to the delivery address provided by the Customer or, where applicable, when the package is collected from the carrier.
11. ORDER RECEIPT
11.1 Late delivery/no delivery
Loss of parcel during transport
Aroma-Zone chooses reliable partners to take charge of the routing and delivery of packages. However, a delay or loss of a parcel is possible although occasional. However, as with any shipment, there may be a delay in delivery or the parcel may go astray. In the event of a delay in delivery of more than 7 days, the Customer must inform Aroma-Zone's Customer Service, who will pass on the information to the carrier in order to initiate an investigation. This investigation may last up to 21 days from the date of its opening. If the parcel is found during this period, it will immediately be returned to the Customer's home address (in the majority of cases). If, on the other hand, the parcel is not found at the end of the 21-day investigation period, it will be considered lost. In this case, Aroma-Zone will send a replacement parcel to the Customer, at the Customer's expense. If the lost product(s) are no longer available at that time, Aroma-Zone will reimburse the Customer the total amount of the order placed, including shipping costs.
11.2 Returns with the reason "unclaimed"
Returns of parcels that have not been claimed by the Customer at the end of the retention period stipulated for the delivery method chosen (post office, retailer, Click&Collect in an Aroma-Zone boutique) will be reimbursed the total amount of the order, postage and return costs deducted, via the initial means of payment for the order within forty-eight (48) hours following receipt of the returned parcel by Aroma Zone. The Customer may then place their order again, choosing the delivery method and conditions of their choice.
11.3 Returns with the reason "NPAI"
Returns of parcels for which delivery has been impossible due to an incomplete or erroneous address, a letterbox or a recipient not allowing delivery (not accessible, not identifiable, not available, etc.) will be reimbursed the total amount of the order, postage and return costs deducted, via the initial means of payment for the order within forty-eight (48) hours following receipt of the return parcel by Aroma Zone. The Customer may then place the order again, ensuring that the delivery address provided is correct.
11.4 Returns following a refusal of customs clearance
Returns of parcels which cannot be delivered due to customs clearance being refused by the Customer or due to unauthorised import at destination will be refunded the full amount of the order, less postage and return costs, via the original payment method used for the order within forty-eight (48) hours of receipt of the return parcel by Aroma Zone. In the event of abandonment of the goods at customs leading to the destruction of the goods at destination as a result of a refusal to clear customs, no refund of all or part of the order may be requested.
11.5 Order cancellation
In the event of a delay in delivery of more than 7 days in relation to the scheduled delivery date, the Customer may cancel his/her order by contacting Aroma-Zone Customer Service by email or telephone or by clicking here.
11.6 Defects
Each delivery is deemed to have been made as soon as the Product(s) have been made available by the Carrier to the Customer, or to a third party indicated by the Customer. It is the Customer's responsibility to check immediately upon receipt of the Product(s) the conformity and integrity of the Product(s) dispatched.
Any anomaly must be reported as soon as possible and at the latest within 48 working hours following delivery of the order and before any use to Customer Services. Customer Service will be entitled to request any information that will enable the problem to be resolved quickly.
Article 12 - RIGHT OF WITHDRAWAL - RETURNS - REFUNDS
12.1 Time limit and procedures for exercising the right of withdrawal
Pursuant to Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights and Law 2014-344 of 17 March 2014 as transposed into Articles L. 221-18 et seq. of the Consumer Code, any consumer is entitled to cancel their order at any time within 14 calendar days of the date on which they received the Article(s) and this without having to justify their reasons or pay any penalties, provided that the Products are returned in their original packaging, complete (i.e.; accessories, instructions), in perfect condition and unopened.
This withdrawal period expires 14 days after the day on which the Customer or a third party other than the carrier and designated by the Customer, takes physical possession of the Order.
If the aforementioned deadlines are not respected, Aroma Zone will not be able to reimburse the Product(s) concerned. The sale will be considered firm and final.
In accordance with article L.221-18 of the French Consumer Code, only products that are unopened, unopened, unopened, unopened, complete and undamaged may be the subject of a right of withdrawal.
12.2 Returning products

Products must be accompanied by the returns form which can be downloaded here or the following information on plain paper: first and last name, e-mail address, order number and date.
The cost of returning the Products shall be borne by the Customer.
Aroma-Zone cannot be held responsible in the event of the return being lost in the post.
12.3 Refunds
In the event that the Customer retracts part of the Products in the order, Aroma-Zone will reimburse the amount of the Products returned, excluding shipping costs, which are fixed for an order of several products.
If the Customer withdraws from the entire order, Aroma-Zone will reimburse all payments received from the Customer for this order.
In the event that the Customer withdraws from part of the order, Aroma-Zone will reimburse the amount of the Products returned.
The reimbursement will be made by the same means of payment that the Customer used for their order or by bank transfer.
Aroma-Zone may defer this reimbursement until receipt and verification of the Products.
ARTICLE 13 - LEGAL WARRANTIES: NON-CONFORMITY AND SPURIOUS DEFECTS
13.1 Common provisions

The seller is liable for any lack of conformity of the goods with the contract in accordance with article L.217-4 et seq. of the French Consumer Code and for any hidden defects in the goods sold in accordance with article 1641 et seq. of the French Civil Code.
Consumers have a period of two years from the date of delivery of the goods in which to invoke the legal guarantee of conformity in the event of a lack of conformity.

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund in exchange for the return of the goods, if:

1° The trader refuses to repair or replace the goods.

2° The goods are repaired or replaced after a period of thirty days.
***
3° The repair or replacement of the goods causes a major inconvenience for the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or if he bears the cost of installing the repaired or replacement goods.

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
***
The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious as to justify immediate reduction in the price or rescission of the contract.

In such cases, the consumer is not obliged to ask for the goods to be repaired or replaced beforehand. The consumer is not entitled to have the sale rescinded if the lack of conformity is minor.

Any period of immobilisation of the goods with a view to their repair or replacement suspends the warranty that was in force until delivery of the repaired goods.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.

Any seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual sales(article L. 241-5 of the French Consumer Code).

Consumers also benefit from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect.

This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund if the goods are returned.

13.2 Procedure to be followed
Once Aroma-Zone has been informed of the Customer's wish to exercise one of the aforementioned legal warranties, Aroma-Zone's Customer Service will acknowledge receipt of the Customer's request and indicate the procedure to be followed. Upon receipt of the instructions from Aroma-Zone Customer Service and the corresponding return form, the Customer will return the non-conforming Products or those affected by a hidden defect to Aroma-Zone at the address indicated by Customer Service.
Any Product returned must be complete, unused (except in the case of a hidden defect) and, as far as possible, accompanied by its original packaging as well as the return form and a photocopy of the invoice.
Upon receipt of the Product(s) presumed to be non-compliant or affected by a hidden defect, Aroma-Zone will check the Product(s) to determine whether or not they are compliant. Similarly, Aroma-Zone may carry out a quality test on the Product(s) returned by the Customer to verify that the Product(s) returned are indeed the original Product(s). It is understood that these checks are carried out as quickly as possible and within a maximum period of one (1) month.
13.3 Content of legal guarantees
If the non-compliant nature of the Product(s) is confirmed or the hidden defect is proven: the Customer may choose between repairing or replacing the Product, subject to the cost conditions set out in article L. 217-12 of the French Consumer Code. It should be noted that the Customer (i) has a period of two (2) years from the date of delivery of the Product in which to take action and (ii) is exempt from having to prove the existence of the Product's lack of conformity during the twenty-four (24) months following delivery of the Product.
In the event that the Customer invokes the warranty against hidden defects in the item sold within the meaning of article 1641 of the French Civil Code, the Customer may choose between rescinding the sale or reducing the sale price in accordance with article 1644 of the French Civil Code.
In the event that the non-conformity or defect of a returned Product is not confirmed, Aroma-Zone will contact the Customer to agree on the next step. In this case, any reshipment will be at the Customer's expense.
ARTICLE 14. INTELLECTUAL PROPERTY
All elements of the Website, whether visual or audio, including the underlying technology, are the exclusive property of HYTECK and are protected by copyright and trademark law.
Thus, HYTECK is the exclusive owner of the intellectual property rights on the following elements, without this list being exhaustive:
The Products offered on the Site and the brands associated with the Products;
The Site, its visual and graphic identity, its design, its functionalities, the texts, the animated or still images, the sounds, the know-how, the graphics and any other element composing the Site;
All design elements of the Site, whether graphic or technical;
Names, acronyms, logos, colours, graphics or other signs which may be used,
HYTECK is also the exclusive owner of the domain name "ww.aroma-zone.com".
Consequently, the total or partial reproduction of any of these elements, directly or indirectly, on any medium whatsoever and for any reason whatsoever, without the prior express consent of Aroma Zone is strictly prohibited.
The fact that Aroma Zone does not initiate proceedings as soon as it becomes aware of such unauthorised use does not imply acceptance of said use and waiver of legal action. Any simple link or hypertext link is strictly forbidden without the express written consent of Aroma Zone.
ARTICLE 15 - PROTECTION OF PERSONAL DATA
The personal information collected in the context of distance selling is compulsory, as this information is necessary for the processing and delivery of orders and for the preparation of invoices. This information is strictly confidential and is not passed on to third parties.
The information collected is subject to computer processing for which HYTECK is responsible and is intended for HYTECK in order to inform the Customer of HYTECK AROMA ZONE's product and service offers.
In accordance with the French Data Protection Act of 6 January 1978 as amended, the Customer has the right to access, modify, rectify and delete data relating to it. To exercise this right, the Customer must make a request:

The Customer may refer to the Site's personal data charter (Personal Data Charter - Aroma zone) for full information on the purposes, recipients, retention periods and conditions under which Aroma-Zone collects and processes data concerning you.
This personal data charter sets out in full the information concerning the processing of personal data as well as the rights of the persons concerned in relation to such processing.
ARTICLE 16 - LIABILITY
Aroma-Zone shall not be held liable under these Terms in the event that the damage or non-performance of our obligations is attributable to the act of a third party, to your fault (see in particular the conditions of use set out in article 3.2) or to an event of force majeure as defined in article 17.
Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, in particular with regard to technical performance, response times, connection times, queries or transfers of information, risks of disconnection, risks of contamination by viruses circulating on the network and, in general, all the risks associated with the use of the Internet network. In this respect, the Customer acknowledges that it is their responsibility to install appropriate anti-virus and security software on their computer hardware and any other device in order to protect them against any bugs, viruses or other programming routines of this kind that may prove harmful.
Aroma Zone will not be held responsible for any direct or indirect damage resulting from misuse or incidents related to the use of the computer, access to the Internet, maintenance or malfunction of servers, telephone lines or any other technical connection, as the Customer's connection to the Site is at their own risk.
Aroma Zone is only obliged to deliver Products that comply with the contractual provisions.
The Products sold on the Website comply with the regulations in force in France.
Aroma-Zone cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from the improper use of the products sold.
All documents, descriptions and information relating to the Products appearing on the Website are provided "as is", without being covered by any guarantee, explicit or implicit, with the exception of guarantees provided by law.
In view of the nature of the Products, you are reminded that the information provided should not be assimilated to medical advice or recommendations. Any intended use in a therapeutic context or for the treatment of a situation (e.g. illness, infection, etc.) must be subject to prior consultation with a qualified doctor or pharmacist.
ARTICLE 17 - FORCE MAJEURE
Neither Party shall be liable for the total or partial non-performance of its obligations under these General Terms of Sale if such non-performance is caused by an event constituting force majeure.
Events meeting the criteria laid down by the case law of the Cour de Cassation (French Supreme Court) and by legislation are considered to be cases of force majeure.
The Party invoking an event constituting force majeure must notify the other Party within five (5) working days of the occurrence of said event. The Parties agree that they must consult each other as soon as possible in order to determine together how the order will be carried out for the duration of the force majeure event. After a period of one (1) month of interruption due to force majeure, Aroma-Zone will be free to cancel the order, at its own discretion, and will reimburse the Customer where applicable.
ARTICLE 18 - AMENDMENT OF THE GENERAL TERMS OF SALE
It is specified that the Customer may save or print these General Terms of Sale, provided that they are not modified.
The current General Terms of Sale may be consulted at any time under the heading "General Terms of Sale", which can be accessed from any page of the Site. The version of the General Terms of Sale applicable will remain those in force at the time the order was placed (i.e. payment for the Products in the basket).
Aroma-Zone may update these GTC at any time. Any such update will be the subject of prior and specific notification on the Site.
The Customer expressly consents to the new version of the GTS by validating a new order.
ARTICLE 19 - APPLICABLE LAW - SETTLEMENT OF DISPUTES
The relationship between Aroma-Zone and any User/Customer is subject to French law. The choice of French law shall not, however, deprive a consumer Customer residing outside France of the application of the mandatory consumer protection provisions of the law of the country in which the Customer has their habitual residence, provided that Aroma-Zone carries on its business or directs its business to that country.
In the event of difficulties in the application of the present contract, the Customer has the possibility, before taking any legal action, to seek an amicable solution, notably with the help of a professional association in the sector, a consumer association or any other advisor of their choice. Complaints or disputes will always be received sympathetically, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the Customer must first contact Aroma-Zone in order to obtain an amicable solution.

In accordance with article R.631-3 of the French Consumer Code: " The consumer may refer the matter either to one of the courts with territorial jurisdiction under the Code of Civil Procedure, or to the court for the place where they lived when the contract was concluded or when the harmful event occurred ".
ARTICLE 20- PARTIAL INVALIDITY
If one or more stipulations of these GTS are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations retain all their force and scope.
ARTICLE 21 - FULL GENERAL TERMS OF SALE
These GTS and the order summary sent to the Customer form a contractual whole and constitute the entire contractual relationship between the Parties.
In the event of any contradiction between these documents, the GTS shall prevail.
