The purpose of these Terms and Conditions of Sale is to define the terms and conditions of distance selling between Aroma-Zone, on the one hand, and any individual who is not a merchant and who is of legal age or a minor, with the prior consent of their legal representative only, making a purchase on the Website (hereinafter referred to the "Customer"), on the other hand.

The purpose of these Terms and Conditions is to define the rights and obligations of the Customer in the context of the purchase of Gift Cards via the www.aroma-zone.fr website. They also define the commitments and responsibilities of Aroma-Zone concerning the supply of these Gift Cards.

These Terms and Conditions apply to the exclusion of any other document, and in particular any of the Customer's conditions of purchase.

It should be noted that the Customer may save or print these T&Cs, provided that they are not modified. The current T&Cs can be consulted at any time under the heading "Terms and Conditions of Sale", which can be accessed from any page of the Website. The applicable version of the T&Cs will be the one in force at the time the order was placed (i.e. when payment was made for the Products in the basket).

Aroma-Zone may update these T&Cs at any time. Any such update will be the subject of specific prior notification on the Website.

The Customer expressly agrees to the new version of the T&Cs when they confirm a new order. You can access the current version of the Terms and Conditions of Sale on www.aroma-zone.com.

3.1. Field of application

Gift Cards are valid for the purchase of products or services offered on the www.aroma-zone.com Website or in the company's physical shops.

3.2. Combined card usage

It is possible to use multiple Gift Cards to pay for a single product or service.

3.3. Transferability of Gift Cards

Gift Cards are transferable and can be used by any bearer, as they are not tied to the identity of the initial beneficiary.

3.4. Illegal Gift Cards

Any Gift Card acquired illegally is considered invalid. It cannot be used to make purchases and its value will not be refunded. Aroma-Zone reserves the right to take legal action against holders of such cards.

6.1. Prices

The value of the Gift Cards corresponds to the amount that the Customer decides to load when placing the order.

Aroma-Zone does not charge commission on the price of Gift Cards, so the amount chosen for loading represents the total price of the Gift Card.

Prices are given in euros and include all taxes.

6.2. Payment methods

The payment options available when the order is placed appear automatically at the checkout stage. Aroma-Zone reserves the right to withdraw or add payment methods without prior notice. In addition, payment applications operate under their own Terms of Service.

It is important to note that transactions can only be carried out in euros for countries outside the European Union.

Aroma-Zone reserves the right to cancel an order for just cause, and in particular for an order which, when scored by the fraud detection module, shows a risk of fraudulent card use.

6.3 Payment security

By selecting the card to make payment, the Customer will be automatically redirected to the secure payment platform's electronic payment server.

This platform is secured by SSL (Secure Sockets Layer) encryption to protect all data relating to payment methods.

This banking information is therefore known only to the payment service provider chosen by Aroma-Zone. It is not transmitted or stored on Aroma-Zone's computer systems, nor is it handled or manipulated by its staff.

The communication of your debit or credit card number and your final confirmation of the order constitute proof of your acceptance of the order and the T&Cs. This confirmation takes the place of a signature.

The service offered by the Gift Card is a financial service within the meaning of Directive 2011/83/EU of 25 October 2011 on consumer rights. Under Article 3.3 of Directive 2011/83/EU, financial services are excluded from the scope of the right of withdrawal. You must understand that you do not benefit from the right of withdrawal when ordering your Gift Card.

Under our Returns and Exchanges policy, customers wishing to return products purchased using an Aroma-Zone Gift Card benefit from the following refund provisions:

Full refund on a Gift Card:

If the products were paid for in full using a Gift Card, the refund will only be made in the form of a new Gift Card. The amount of the refund corresponds to the initial total amount paid using Gift Cards for the products returned.

Partial refund on a Gift Card:

If the products were paid for partly with a Gift Card and partly with another payment method (e.g. bank card), the refund will be divided into two separate parts. The part paid for with a Gift Card will be refunded in the form of a Gift Card, while the part paid for with another payment method will be refunded according to the refund terms applicable to that payment method.

All Gift Card refunds are credited to a new Gift Card, the balance of which corresponds to the refund made. This new Gift Card is subject to the same terms of use as the original Gift Card.

Aroma-Zone shall not be held liable under these T&Cs where the damage or non-performance of our obligations is attributable to the act of a third party, to your own fault, or to a force majeure event, as defined by the case law of the French courts.

Placing an order on the Website implies knowledge and acceptance of the procedures in force on the Internet network, particularly with regard to technical performance, response times, connection times, queries or transfers of information, the risk of interruption, the risk of contamination by viruses circulating on the network and, in general, all the risks associated with the use of the Internet network. In this respect, the Customer acknowledges that it is their responsibility to install appropriate anti-virus and security software on their computer hardware and any other devices in order to protect them against any bugs, viruses or other such programming routines that may prove harmful.

Aroma-Zone cannot be held responsible for any direct or indirect damage resulting from misuse or incidents related to the use of a computer; Internet access; maintenance or malfunction of the servers, telephone lines or any other technical connection; as the Customer's connection to the Website is their sole responsibility.

Aroma-Zone is only obliged to deliver E-Gift Cards that comply with the contractual provisions.

The E-Gift Cards sold on the Website comply with the regulations in force in France.

Aroma-Zone cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from the improper use of the products sold.

Neither Party shall be liable for the total or partial non-performance of its obligations under these T&Cs if such non-performance is caused by a force majeure event.

The following events meeting the criteria established by the case law of the French Court of Cassation and legislation, without this list being exhaustive, are considered to be cases of force majeure: natural disasters, fires, floods, storms, internal or external strikes, breakdowns or blockages of telecommunications networks, war, acts of terrorism, epidemics, pandemics or any other circumstance beyond the reasonable control of Aroma-Zone.

The Party invoking a force majeure event must notify the other Party within five (5) working days of the occurrence of said event. The Parties agree that they must consult each other as soon as possible in order to determine together how the order will be carried out during the force majeure event. After a period of one (1) month of interruption due to force majeure, Aroma-Zone will be free to cancel the order, and will reimburse the Customer where applicable.

Each Gift Card sold remains the property of Aroma-Zone until full payment has been received. Failure to pay may result in the Gift Card and/or the products purchased with it being reclaimed.

The transfer of risks to the Customer takes place at the time of delivery or handover of the products.

If one or more stipulations of these T&Cs are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations shall retain all their force and scope.

The relationship between Aroma-Zone and any User/Customer is subject to French law. The choice of French law shall not, however, deprive a consumer Customer residing outside France of the application of the mandatory consumer protection provisions of the law of the country in which the Customer has their habitual residence, provided that Aroma-Zone carries on its business with or directs its business to that country.

In case of difficulties in the application of this contract, the Customer has the option, before any legal action, to seek an amicable solution, in particular with the assistance of a professional association in the sector, a consumer association, or any other counsel of their choice. Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation.

In the event of a dispute, the Customer shall first contact the company to reach an amicable solution.
