1 OBJECT

The Aroma-Zone loyalty programme (hereinafter referred to as the "Loyalty Programme") is a promotional programme set up and managed by Hyteck SA, with share capital of 68,604 euros, registered with the PARIS Trade and Companies Register under number 334 806 502, whose registered office is located at 25 Rue de l'Ecole de Médecine, 75006, Paris.  

This programme aims to reward the loyalty of Aroma-Zone's individual customers by awarding loyalty points on the occasion of certain purchases made on the www.aroma-zone.com website (the "Website") or in shops, under the conditions and within the limits defined herein. Subject to compliance with these General Terms and Conditions, these points may give rise to the issue of Loyalty Benefits that can be used exclusively for the purchase of certain Aroma-Zone products. 

No financial consideration or reimbursement may be demanded under this Loyalty Programme, which remains optional and entirely free of charge.

2 CONDITIONS FOR JOINING THE LOYALTY PROGRAMME

Any customer ("Customer") who has created an Aroma-Zone account, regardless of the registration channel (in a shop or on the www.aroma-zone.com website), automatically joins the Loyalty Programme.  

The Loyalty Programme is exclusively accessible to end consumer customers, with the express exclusion of employees of HYTECK and AROMA-ZONE STORE, professional customers, approved distributors and members of the public administration. 

The Loyalty Programme is free and open to any non-trading natural person, be they an adult or a minor (only with the prior agreement of their legal representative). 

As the Loyalty Programme is intended to offer certain benefits to loyal Aroma-Zone Customers, it is automatically activated when a customer account (the "Account") is created. However, the Customer always has the option not to use the Programme, and/or to contact the Aroma Zone Customer Service department at any time to request their withdrawal free of charge. 

The benefits resulting from the Loyalty Programme are strictly reserved for the Account holder. Loyalty Points and Loyalty Benefits are personal, non-transferable, have no market value and cannot be transferred, reimbursed, compensated or offset in any way, including in the event of deactivation of the Account or non-use of the Loyalty Programme.

3 PERSONAL DATA

3.1 Collection methods

The Customer's personal information or data, processed by Aroma-Zone within the framework of the Loyalty Programme, is processed in accordance with the Personal Data Policy available at the bottom of the Website page. In addition, the Cookie Policy, also accessible at the bottom of the page, details the use of cookies that may be used when browsing the Website, including those linked to the Loyalty Programme functions.  

Aroma-Zone collects personal data concerning the member as soon as the Customer creates an Account, whatever the channel (shops or Website). This information may be collected orally by the sales advisor in a shop or in writing on the www.aroma-zone.com website.


3.2 Data processing and legal bases


The following information is required to join the Aroma-Zone Loyalty Programme: 

  • last name,  

  • first name,  

  • email address.  

Aroma-Zone retains information relating to the member's purchase history and use of the services as soon as the member identifies themselves within the framework of their Account and the management of the Loyalty Programme, and the execution of these General Terms and Conditions of Use (execution of the contract).  Furthermore, on the basis of the member's consent, Aroma-Zone may send the member offers and news or personalised advertising based on the member's previous purchases and/or interests. This information is combined with that collected during interactions with other Aroma-Zone services in order to refine the profile and knowledge of the member. Where the member has accepted the use of cookies and other tracking devices via the banner provided for this purpose, the data collected within the framework of the loyalty programme is also combined with browsing data. This combination allows Aroma-Zone to display targeted advertising on the www.aroma-zone.com Website and on third-party websites.


3.3 Data retention period 


Information relating to members is kept by Aroma-Zone for no longer than is necessary for the purposes for which it was collected, i.e. for the duration of your participation in the Loyalty Programme, plus any applicable legal time limits, in particular for the purposes of keeping proof of transactions and enabling Aroma-Zone to meet its legal obligations. On a practical level:  

  • Inactive customer accounts are deleted after a period of 2 years from the last action on your part (login, purchase, account update, etc.), in accordance with CNIL recommendations. 

  • Data used for commercial prospecting purposes (email or SMS) is kept for a period of 3 years from the last contact from you, unless you object. 

The data may also be used for statistical analysis in an aggregated and anonymised form. The processing does not involve automated decision-making, including profiling, with the exception of the sending of personalised emails based on the member's profile.  Your personal data, processed within the framework of the Aroma-Zone Loyalty Programme, will be deleted if: 

  • You decide to delete your Aroma-Zone Account.

3.4 Data transfers  

In order to manage the Loyalty Programme, some of the Customer's personal data may be transmitted to service providers or partners acting on behalf of Aroma-Zone, located within the European Union or in countries offering an adequate level of protection within the meaning of the General Data Protection Regulation (GDPR). 

Where applicable, transfers to third countries not benefiting from an adequacy decision may be carried out, in strict compliance with the requirements of the GDPR, subject to appropriate safeguards in accordance with Articles 44 et seq. of the GDPR (in particular, the European Commission's standard contractual clauses, as well as additional technical and organisational measures, etc.). 

The sole purpose of this processing is to ensure the proper implementation of the Loyalty Programme, and the data will not be used for any commercial purpose not authorised by the Customer.  


3.5 Data recipients  


Information relating to members is communicated to Aroma-Zone employees, service providers and sub-contractors involved in the management of the Loyalty Programme. 

Aroma-Zone undertakes to enter into a contract in accordance with the regulations in force with any service provider who processes personal data on its behalf, as a subcontractor within the meaning of the GDPR, in order to ensure the implementation of all the measures necessary to guarantee the protection, security and confidentiality of the data processed by the service provider. 


3.6 Member rights 


Members may exercise their right of access and rights to rectification, deletion and portability in writing:

  • by email to the following address: dpo@aroma-zone.com. 

Members may also, under the same conditions, exercise their right to object to the processing of their personal data for canvassing and commercial profiling purposes, or request the erasure of their personal data or the restriction of its processing, in accordance with articles 15 to 21 of the GDPR.

Members may refer any claim or complaint concerning the processing of their personal data to the French National Commission on Informatics and Liberty (www.cnil.fr).

4 HOW THE AROMA-ZONE LOYALTY PROGRAMME WORKS

The Aroma-Zone Loyalty Programme is only available for purchases paid for in euros. Every time you make a purchase in euros, you can collect points and take full advantage of the Loyalty Benefits.  


4.1 Accumulation of Loyalty Points  


For each purchase made in an Aroma-Zone shop or on the Website, the Customer accumulates loyalty points at the rate of one (1) loyalty point ("Loyalty Point(s)") for one (1) euro of items purchased under the following conditions: 

  • The amount taken into account for the allocation of Loyalty Points corresponds to the invoiced amount of the articles or workshops, excluding delivery costs;  

  • Gift card purchases are excluded. 

For purchases made in-store, Loyalty Points are credited immediately after the purchase, except in the event of technical unavailability. For orders placed on the Website, Loyalty Points are credited once payment has been accepted.  

It is specified that the Loyalty Point total is not updated in real time in the Customer Account. The Customer expressly acknowledges that this discrepancy in no way affects the validity of the total or justifies a claim.   

Loyalty Points are valid for six (6) months from the date they are acquired. Points that have not been used by the end of this period are automatically deleted, with no compensation or recourse possible. 

Loyalty Points cannot be converted into cash under any circumstances. They have no monetary value and are not transferable. 

Aroma-Zone reserves the right to rectify any points balance in the event of a technical error, billing anomaly or misuse.


4.2 Conversion to Loyalty Benefits  


Loyalty Points are regularly converted by Aroma-Zone into a purchase voucher which translates into a benefit code (hereinafter referred to as "Loyalty Benefit(s)") according to the following rules:

  • Ten (10) Loyalty Points = one (1) euro credited to the next Loyalty Benefit; 

  • When the Loyalty Benefit is issued, Aroma-Zone takes into account all the Loyalty Points available in the Account to date.  

  • The terms and conditions for calculating and issuing Loyalty Benefits are established at Aroma-Zone's discretion and may be adapted at any time, without any retroactive effect. 

4.3 Loyalty Campaigns  


Loyalty Campaign refers to the system set up by Aroma-Zone to allow for the automatic generation of Loyalty Benefits from Loyalty Points accumulated by the Customer (hereinafter referred to as "Loyalty Campaign(s)"). This mechanism is triggered exclusively on the initiative of Aroma-Zone, at times defined by the latter. The Customer cannot initiate the conversion of their points into Loyalty Benefits and acknowledges that the issue of Loyalty Benefits is left entirely to the initiative of Aroma-Zone. 

The launch of a Loyalty Campaign is subject to a minimum threshold of twenty-one (21) Loyalty Points being reached. Once this threshold is reached, a purchase voucher is automatically generated according to the Customer's Loyalty Point balance, on the following basis: ten (10) Loyalty Points = one (1) euro purchase voucher. 

At this stage, the Customer's Loyalty Points are not debited from their Account. The Loyalty Points will be deducted from the balance when the Customer actually uses the Loyalty Benefit.  

If the Loyalty Benefit is not used, the Loyalty Points concerned will remain attached to the Account until the next Loyalty Campaign, if the Customer uses their Loyalty Benefit, or until their expiry date, in accordance with these General Terms and Conditions of Use of the Aroma-Zone Loyalty Programme. If a Loyalty Benefit is not used, no extension or refund will be granted.


4.4 Use of Loyalty Benefits


Loyalty Benefits cannot be exchanged for cash under any circumstances.  

Customers are informed of the availability of a Loyalty Benefit by email and via their Account in the "Loyalty and benefit codes" section. 

The conditions for using a Loyalty Benefit will be indicated on the Loyalty Benefit, such as the minimum order amount, the period of validity, etc. 

Loyalty Benefits cannot be combined with each other, with other benefit codes or with current promotional offers. They cannot be used to purchase gift cards. 

Loyalty Benefits can be used in shops or on the Website. 

If a Loyalty Benefit is not used by the Customer during its period of validity, it will be converted back into Loyalty Points when it expires and may be the subject of another Loyalty Benefit during the following month, within the limit of validity of the Loyalty Points. 

This conversion does not extend the initial period of validity of said Loyalty Points. 

Loyalty Benefits are personal and non-transferable. 


4.5 Cancellation of Loyalty Points and Loyalty Benefits 

In the event that the Customer exercises their right of withdrawal or returns a product, Aroma-Zone reserves the right to debit the Loyalty Points balance of their Account by the number of Loyalty Points accumulated through the purchase for which a refund is requested. Similarly, the cancellation of a dispatched order will result in the deduction of the associated Loyalty Points. 

Aroma-Zone may also retroactively cancel Loyalty Points in the event of attempted fraud, non-delivery of an order, stock shortages or technical errors affecting the calculation or allocation of Loyalty Points, without the Customer being able to claim any compensation whatsoever.


4.6 If Loyalty Points are not used by the Customer  

If the Customer has not used their Loyalty Points before the end of their validity date, the Loyalty Points collected before this six (6) month period will be lost. 

No damages, conversion or compensation may be demanded in this respect. 

5 RIGHTS RESERVED BY AROMA-ZONE

Aroma-Zone reserves the right to modify these General Terms and Conditions of Use of the Aroma-Zone Loyalty Programme, and will inform the Customer of any modification by the means it deems most appropriate (letter, email, updating of the new General Terms and Conditions on the www.aroma-zone.com Website, etc.). The adaptations or modifications will then apply to any use of the Loyalty Programme subsequent to these adaptations or modifications. The latest version of the General Terms and Conditions applicable to the Loyalty Programme can be consulted on the www.aroma-zone.com Website. Aroma-Zone invites its Customers to consult them regularly.

It is specified that in the event of temporary or definitive termination of the Loyalty Programme, Customers will be informed by the means that Aroma-Zone deems most appropriate (letter, email, SMS, etc.). The Customer will then have a maximum of 30 days in which to take advantage of the benefits, and if they fail to do so within this period, the benefits and Loyalty Points accumulated will be definitively lost. 

Under no circumstances may the Customer exercise any right of recourse or claim in respect of the loss of Loyalty Points, nor claim any compensation or damages whatsoever.

No modification or cancellation of the Loyalty Programme will entitle the Customer to compensation.

6 DURATION – SUSPENSION – DEACTIVATION

Membership of the Loyalty Programme is established for an indefinite period.

Customers may terminate their account at any time by sending a request for deletion. To do so, the Customer must send us a request by post to the following address: Hyteck Aroma-Zone – DPO – 1366, Route de Gordes – 84220, Cabrières d'Avignon – France or by email to: dpo@aroma-zone.com.

Membership data will be kept for as long as the Account is active and, where applicable, archived for the legal period applicable after deregistration, unless otherwise required by law.  

The Loyalty Programme is a promotional programme designed to provide benefits to loyal Aroma-Zone Customers based on the purchases they make in shops or on the Website. This Loyalty Programme assumes that the Customer complies with these General Terms and Conditions of Use of the Aroma-Zone Loyalty Programme and acts in a loyal manner towards Aroma-Zone, in line with the purpose of the programme.  Consequently, Aroma-Zone reserves the right to suspend an Aroma-Zone Loyalty Programme, or even to permanently deactivate a Loyalty Programme and, where applicable, cancel the associated benefits, in the event of fraud or abuse by the Customer in the use of the Aroma-Zone Loyalty Programme and/or vis-à-vis Aroma-Zone. Aroma-Zone will proceed with this suspension or deactivation after having notified the Customer, by the means it deems most appropriate, without the Customer being able to claim any compensation or subsequent reactivation. This decision may be taken in the following cases:  

  • in the event of fraud, attempted fraud or theft by the customer in the shop and/or on the www.aroma-zone.com Website, 

  • in the event of inappropriate use or misuse of the Aroma-Zone Loyalty Programme, 

  • in the event of actions likely to disrupt the operation of the www.aroma-zone.com Website, the operation of the Aroma-Zone Loyalty Programme or the operation of the shops, 

  • in the event of an abnormally high number of transactions over a short period,  

  • in the event of a payment incident that is not rectified within one (1) month of the reminder, 

  • more generally, in the event of failure to comply with the provisions of these General Terms and Conditions. 

The loss of benefits, Loyalty Points or Loyalty Benefits resulting from this deactivation may not be the subject of any claim, compensation or conversion, for any reason whatsoever.

7 LIABILITY

Aroma-Zone is absolved of any liability for all consequences, direct or indirect, of any malfunctioning of the Aroma-Zone Loyalty Programme beyond its control or relating to benefits that members may have enjoyed, whatever the cause of these anomalies. 

Aroma-Zone will nevertheless do its utmost to ensure that, in the event of a malfunction, the Customer retains the benefit of the Loyalty Programme.

8 MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF THE LOYALTY PROGRAMME

Aroma-Zone reserves the right to change the Loyalty Programme at any time and to modify or add to these General Terms and Conditions of Use of the Aroma-Zone Loyalty Programme. The latest updated version will be dated and available for consultation on the Website and may also be requested in shops.

Aroma-Zone also reserves the right to interrupt or terminate the Loyalty Programme, subject to prior notice to Customers, by whatever means it deems most appropriate. 

In the event of any modification to these Terms and Conditions of the Aroma-Zone Loyalty Programme, the latest version will be brought to the Customer's attention online and will apply automatically only to transactions carried out after its date of application, with no retroactive effect on previous transactions.

9 CLAIMS – INFORMATION

For any information, claim or question relating to the Loyalty Programme, the Customer is invited to contact Aroma-Zone by visiting the "Contact us" section of the Website. 

No claim can be processed outside this official communication channel.

However, for any request relating to the protection of personal data, the Customer may contact the Aroma-Zone Data Protection Officer (DPO) by email at the following address: dpo@aroma-zone.com.

10 PARTIAL INVALIDITY

If one or more stipulations of these General Terms and Conditions are deemed illegal, null and void or inapplicable, this nullity will not result in the nullity of the other provisions, which will remain in full force and effect.

The clause in question will, as far as possible, be interpreted in such a way as to preserve its economic effect, or failing that, replaced by an equivalent stipulation in keeping with the spirit of the Loyalty Programme.

11 DISPUTES – APPLICABLE LAW – JURISDICTION

These General Terms and Conditions of the  Loyalty Programme are governed by French law. Only the French version of these General Terms and Conditions of Use of the Loyalty Programme shall prevail.

The relationship between Aroma-Zone and any User/Customer is subject to French law. The choice of French law shall not, however, deprive a consumer Customer residing outside France of the application of the mandatory consumer protection provisions of the law of the country in which the Customer has their habitual residence, provided that Aroma-Zone carries on its business with or directs its business to that country. 


11.1 Attempt at amicable resolution 


In the event of difficulties in the application of this contract, the Customer may, before taking any legal action, contact the Aroma-Zone Customer Service department via the online form available in the "Contact us" section, or by telephone on +33 (0)4 13 35 50 00. 

The Customer is also encouraged to seek an amicable solution with the assistance of a professional association in the sector, a consumer association, or any other counsel of their choice. 

In accordance with Articles L.612-1 et seq. of the French Consumer Code, Aroma-Zone subscribes to the services of the CM2C consumer mediator:

In the event of a written claim that has not been resolved within two (2) months, the Customer may refer the matter free of charge to the consumer mediator. 


11.2 European Online Dispute Resolution Platform


In accordance with Article 14 of Regulation (EU) no. 524/2013, the European Commission has also made available to consumers a European Online Dispute Resolution (ODR) platform accessible via the following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR


11.3 Jurisdiction

In accordance with Article R.631-3 of the French Consumer Code, in the event of a legal dispute: "The consumer may bring the matter either before one of the courts having territorial jurisdiction under the Code of Civil Procedure, or before the court for the place where he resided when the contract was concluded or when the harmful event occurred".
